Nos organisations saluent la parution du rapport historique du Rapporteur Spécial, qui conclut que les autorités israéliennes commettent le crime d’apartheid. Sa conclusion devrait être un signal d’alarme pour les gouvernements dans le monde entier.

L’étude du Rapporteur sur l’apartheid dans les territoires palestiniens occupés depuis 1967 reflète la réalité plus large du régime d’apartheid israélien sur l’ensemble du peuple palestinien. Depuis 1948, Israël a établi et maintient un régime d’apartheid sur le peuple palestinien, où qu’il se trouve, y compris sur des réfugiés palestiniens auxquels est refusé le droit au retour dans leurs maisons, sur leurs terres et dans leurs biens.

Le deux poids deux mesures sur cette question, Europe et États-Unis compris, porte gravement atteinte à l’effectivité et à la légitimité des droits humains internationaux et des normes juridiques humanitaires.

Pendant des années, la communauté internationale a permis l’impunité d’Israël et a failli à tenir les coupables d’Israël responsables de graves crimes contre les Palestiniens. La reconnaissance de sa responsabilité accuse un grand retard.

Le lancement de la Nakba en 1948 a fait de 85% du peuple palestrinien des réfugiés et des personnes déplacées à l’intérieur du pays. Le nouvel État d’Israël dans la Palestine historique a installé un régime juridique visant à institutionnaliser la dépossession du peuple palestinien indigène. Après l’occupation de la Cisjordanie, y compris de Jérusalem Est et de la bande de Gaza en 1967, Israël a étendu et rendu opérationnel son système d’apartheid dans les TPO.

Afin de maintenir son régime d’apartheid, Israël a recours à un large éventail de politiques répressives pour soumettre et contrôler les Palestiniens, dont la détention arbitraire, l’usage excessif de la force, la torture, les punitions collectives, la persécution des défenseurs et organisations de défense des droits humains et la violence structurelle, qui empêchent les Palestiniens de jouir pleinement de leurs droits humains, allant jusqu’à des actes inhumains d’apartheid.

Le Rapporteur a identifié la fragmentation stratégique du peuple palestinien comme « stratégie centrale » de l’apartheid israélien. En divisant le peuple palestinien en au moins quatre catégories distinctes géographiques, juridiques et politiques, Israël s’assure que les Palestiniens ne peuvent pas se rencontrer, se regrouper, vivre ensemble ou exercer aucun droit collectif, en particulier leur droit à l’autodétermination.

Nous réitérons le besoin de mesures effectives de démantèlement de l’apartheid israélien, ainsi que cela a été mis en avant par le Rapporteur Spécial et par la société civile, ce qui implique pour les États membres de reconnaître l’existence de l’apartheid israélien contre le peuple palestinien, la reconstitution du Comité Spécial de l’ONU contre l’Apartheid, la ratification et/ou la mise en oeuvre de la Convention contre l’Apartheid et la reddition de comptes à la Cour Pénale Internationale et aux Tribunaux d’États tiers.

Il est temps d’agir et d’adopter des mesures effectives incluant des sanctions pour mettre fin à l’apartheid israélien.
